Preamble

Use of the www.42lausanne.ch website (hereinafter referred to as "the Site") is conditional upon full acceptance of the general terms and conditions of use set out below. These conditions of use may be amended or supplemented at any time, and users of the Site are therefore advised to consult them regularly.

The Site is normally accessible to users at all times. An interruption for technical maintenance may however be decided by the 42 Lausanne association, which will then endeavour to inform the user in advance of the dates and times of the intervention.

Article 1 - Presentation of the website

The purpose of the Website is to provide general information relating to 42 Lausanne and the teaching methods of the 42 network, in particular concerning its philosophy, the conditions for enrolment, the educational pathway or the career options available after schooling at 42 Lausanne. It also gives students access to all the services and information provided by 42 Lausanne throughout their studies at the school.

Article 2 - Contractual limitations on technical data

The minimum recommended configuration for access to the Site is as follows:
- Browsers: Chrome, Firefox, Safari, Opera
- Screens: Smartphone, Tablet, Laptop, Desktop

The user of the Site undertakes to access the Site using hardware that meets the configuration requirements described above, and does not contain any viruses.

Article 3 - Intellectual property

The name "42", the logos, slogans and registered or unregistered trademarks represented on this site are the exclusive property of the Association 42 à Paris. Any use, reproduction and/or modification thereof without the prior written consent of Association 42 may constitute an infringement within the meaning of the French Intellectual Property Code and may render the infringer civilly and/or criminally liable.

The presentation and content of the Website together constitute a work protected by the intellectual property laws in force, of which Association 42 Lausanne is the joint owner with Association 42 Paris. It may not be reproduced and/or represented, in whole or in part, without the prior written consent of the association 42 Lausanne.

The drawings, photographs, images, texts, animated sequences with or without sound, databases, software and other documentation represented on the Website are the subject of industrial and/or intellectual property rights and are, as the case may be, the property of the association 42 Lausanne or of third parties who have restrictively authorised the association 42 Lausanne to use them.

As such, any reproduction, representation, adaptation, translation and/or modification, in part or in full, or transfer to another site is prohibited.

The same applies to the extraction and re-use of the content of the databases accessible from the Site, which are protected by the European Directive of 11 March 1996 on the legal protection of databases.

As such, any reproduction, re-use or extraction of the content of the database would incur the user's liability.

Article 4 - Personal data and cookies

As part of the operation of the Website, the 42 Lausanne association is required to collect a certain amount of personal data concerning the user. Some of the user data, in particular all data relating to the admission process and the management of internship places, is collected by the Association 42 in Paris.

This personal data is processed by the Association 42 Lausanne in accordance with the Federal Data Protection Act (LPD). The personal data that is processed by Association 42 in Paris, is processed in accordance with Act no. 78-17 of 6 January 1978 as amended and the General Data Protection Regulation no. 2016/679 of 14 April 2016 (GDPR).

To obtain information about the personal data processed by Association 42, users are invited to consult the page dedicated to the protection of personal data present on the Association 42 website, which manages the sites that use personal data.

In addition, the user's browsing of the admissions.42lausanne.ch is likely to result in the installation of cookies on the user's computer.

Article 5 - Limitation of liability

Association 42 Lausanne endeavours to provide information on the Website that is as accurate as possible. However, 42 Lausanne may not be held liable for any omissions, inaccuracies or failures to update the information, whether these are its fault or the fault of third-party partners who provide the information.

42 Lausanne reserves the right to modify the content of the Website at any time and without prior notice, or to interrupt or suspend all or part of the Website's functions at any time and without prior notice. It may not be held liable for the consequences of these modifications and interruptions.

The user is liable to the association 42 Lausanne and/or third parties for any material and/or immaterial, direct and/or indirect loss of any nature whatsoever caused by the user and/or his/her employees as a result of the use of the Website that does not comply with these terms and conditions. The user/s guarantees the 42 Lausanne association, as well as its parent, sister or affiliated company, its representatives, its employees, its partners, against any request, claim and/or recourse of any kind, resulting from any breach of the said provisions.

Article 6 - Law and attribution of jurisdiction

Any possible dispute relating in particular to the application, execution, interpretation and/or validity of the General Terms and Conditions of Use and/or the use of the Site and/or the services offered, which cannot be resolved amicably, shall be subject to Swiss law as regards the public site and to French law as regards the admission site and the site for the publication of internship places.
